TERMS AND CONDITIONS

Please read these Terms and Conditions carefully – by using the services of JC Fisher Painting and Decorating you are entering into a contract with us and agreeing to the following terms and conditions.

 

SECTION 1 - ESTIMATES AND PRICING

Property Inspection

JC Fisher Painting and Decorating only accepts orders for services once an inspection of the property or area to be decorated has been completed.

When placing an order the customer shall set out, in detail, the services required. Details required include the location and size of the property, the number and type of rooms which are to be decorated, the type(s) of decorating required (e.g. painting, wallpapering etc.).

Once the inspection is complete, JC Fisher painting and Decorating shall prepare and submit an estimate to the customer either by email or first class post which shall set out the required fee.

Acceptance and Changes To Your Estimate

Any estimate is subject to revision, if a customer makes changes to their property or building after receiving an estimate, customers must let us know of all changes made as soon as possible, so that their quote can be revised.  Any changes made without notifying us, may cause a delay in the work until a price has been agreed for any changes.

The estimate shall include the price payable for the services and for the estimated parts or other goods required to render the services.

JC Fisher Painting and Decorating will use their best and reasonable endeavours to use only the parts or other goods (and quantities thereof) set out in the estimate and the agreement; however if additional parts or other goods are required the final fee shall be adjusted to reflect this. Any such increases shall be kept to a minimum.

In the event that the price of parts or other goods or services increase during the period between the customer’s acceptance of the estimate and the commencement of the provision of the services, JC Fisher Painting and Decorating shall inform the Customer of such increase and of any difference in the final price and agree a revised cost.

The customer shall be free to make changes to the order and estimate prior to acceptance. The customer may accept the quotation by telephone, email or post.

The acceptance of the estimate, electronically or by any other means signifies a full acceptance and commitment to accept these terms and conditions.

The estimate written by JC Fisher Painting and Decorating for the customer represents the requests of the customer. It is not a builder’s survey and we will not be held liable for any task that is not included in the written estimate.

Estimates are valid for 28 days from the date of issue.

Condition of Existing Walls and Ceilings

Unless specifically mentioned, no provision is made for repair of plastering beneath papered walls or ceiling surfaces, as it is assumed that such plastering is in good condition and is suitable to take treatment specified. Similarly, the costs of the repairs and renewals of any defects which are not visible at the time of estimating will be chargeable, unless allowance for such items is included.

Materials

All necessary materials can and will be provided by us unless otherwise agreed and will always be of high quality and used in an appropriate manner as per the manufacturer's guidelines. Where it is necessary to match existing decor, our work will be carried out with this in mind, using appropriate materials that provide an exact match where possible. If an exact match will not be achievable, the customer will be consulted. JC Fisher Painting and Decorating are not responsible for the performance or suitability of any materials, parts or products purchased directly by the client and allow JC Fisher Painting and Decorating to use these at their own risk.

Completion Timescales

Estimated completion times are guidelines and although we will endeavour to complete the work in the time frame intimated, we will not be held liable for failure to complete the scheduled works within the estimated time frame. Similarly, it may be that by providing extra time or resources we can finish a project more quickly than estimated. In which case the price of the quote will not change.

 

SECTION 2 - PAYMENTS AND INVOICES

Deposits

Once an estimate is accepted a deposit may be required no less than 7 days prior to work commencing, this will be agreed at the time of acceptance. The deposit shall be 20% of the quoted fee or a smaller amount agreed between JC Fisher Painting and Decorating and the client.

Invoices

JC Fisher Painting and Decorating shall invoice the customer when the provision of the services is complete, unless otherwise agreed.

We accept Cash, Cheques and Bank Transfers for settlement of your account.

All invoices must be paid within 14 working days of receipt by the customer.

Unpaid Accounts

In the event that JC Fisher Painting and Decorating cannot recover any outstanding amounts after a reasonable amount of time, we will employ the services of a debt collection agency. The customer accepts that the debt collection agency will increase the outstanding amount to cover their costs - this fee is applied as soon as the debt is passed from us to them - it is therefore strongly in your interests to settle your invoice as soon as possible to avoid these extra costs. Once the debt passes from us to the debt collection agency, we have no further involvement in the account and cannot reverse the process or any associated fees.

SECTION 3 - SERVICES

The Services shall be rendered in accordance with the specification set out in the accepted estimate (as may be amended by mutual agreement from time to time).

JC Fisher Painting and Decorating shall ensure that the services are rendered with reasonable care and skill and to a reasonable standard which is commensurate with best practice in the decorating trade.

Additional work

We are in most cases happy to do small “favours” for our clients over and above our quotations however this is expressly done at your own risk and we will not accept any responsibility for any work undertaken that is not in your written estimate, including loss or damage to persons or property.

Precautions

We will take every possible precaution to ensure that all vulnerable areas and any objects left in the work area are carefully and thoroughly covered and/or masked. However, there will always remain a very small risk of overspill or dust getting past these precautions. In the rare event of overspill, dust or other cosmetic damage, we will endeavour to ensure that it is satisfactorily cleaned.

Furniture Removal and Damages

It is the responsibility of the client:

  • To remove valuable and/or fragile items from the areas to be decorated.

  • To remove pictures and other items hanging from the wall.

  • To remove electrical goods from the areas where works will be carried out.

Assistance can be provided with the repositioning and/or removal of bulky furniture items and goods. We reserve the right to decline to move goods if the condition is at risk of damage to the equipment or the property. We reserve the right to decline to move particularly heavy or bulky items if they present a higher than accepted health and safety risk. Where items cannot be covered or protected, but could easily have been removed, we will request that they are removed before work commences. We cannot be held liable for damage to such items if they are not removed.

Where any doubt exists as to the suitability and or structural soundness of any working platform such as balcony, flat roof etc. the client may be asked to provide professional evidence such as structural engineers report prior to works commencing. Where a roof of any type / style is to be used to gain access for external decoration works to JC Fisher Painting and Decorating accept no liability for any damage to have been caused as a result of utilising for access during the works.

In the event of breakage or damage to the property, JC Fisher Painting and Decorating will notify the customer immediately and set out steps to remedy the situation. Similarly, if at the end of the job the client is dissatisfied with any aspect of the service, they must inform us as soon as possible. Clients must allow JC Fisher Painting and Decorating to effect a remedy using our own tradespersons and under no circumstances will we be held liable for the costs of reparations by third parties that we have not expressly agreed to in writing. The client must notify JC Fisher Painting and Decorating, in writing within 24 hours of an alleged breakage or damage caused by us.

Customer’s Obligations

If any consents, licenses or other permissions are needed from any third parties such as landlords, planning authorities, local authorities or similar, it shall be the customer’s responsibility to obtain the same in advance of the commencement of the services.

The customer shall ensure that JC Fisher Painting and Decorating can access the property at the agreed times to render the services.

The customer shall ensure that JC Fisher Painting and Decorating has access to electrical outlets, sanitary facilities and a supply of running water when required.

The customer must give JC Fisher Painting and Decorating at least 24hours notice if JC Fisher Painting and Decorating will be unable to provide the services on a particular day or at a particular time. JC Fisher Painting and Decorating will not invoice for cancelled visits provided such notice is given. If less than 24hours notice is given JC Fisher Painting and Decorating reserve the right to invoice the customer at their normal rate.

 

SECTION 4 - CANCELLATION

We understand that sometimes our customers need to reschedule and this can be done at anytime, however we would request that you provide us with as much notice as possible.

Our customers have the right to cancel before the agreed start date without charge unless the materials have already been purchased, in which case the customer shall become liable for these cost.

JC Fisher Painting and Decorating may cancel the job at any time before the agreed date and shall refund all sums paid, including the deposit.

 

SECTION 5 - LIABILITY, INDEMNITY AND INSURANCE

JC Fisher Painting and Decorating shall ensure that they have in place at all times suitable and valid Public Liability Insurance.

JC Fisher Painting and Decorating is not liable for any loss or damage suffered by the customer which results from the Customer’s failure to follow any instructions given by JC Fisher Painting and Decorating.

Nothing in these Conditions affect the liability of either party or for death or personal injury caused by negligence or for fraudulent misrepresentation.

JC Fisher Painting and Decorating will not be held liable for any for any failure in performing its obligations under this agreement due to circumstances beyond its reasonable control.

The parties agree to submit to the Jurisdiction of the English Courts.

 

SECTION 6 - OUR COMPLAINTS POLICY

We always endeavour to provide the best service and products for our customers. However, on rare occasions, we recognise that there may be times where our customers may not be completely satisfied. In the unlikely event there is anything you are not completely satisfied with, please contact us as soon as you can in order that we can rectify any problems as soon as possible.

 

SECTION 7 - PRIVACY POLICY

We will never sell or otherwise pass on your contact details to any other company or third party, unless required to do so by law. When you contact us, your details may be retained to assist with your enquiry and for correspondence.
